These Terms and Conditions (“Terms”) govern your use of the Anyseller (Pty) Ltd platform (“Marketplace”), which enables Sellers to list products and services and Consumers to purchase them using supported payment methods and delivery services. By registering as a Seller, Consumer, or Service Provider, you agree to these Terms.
- Definitions
- “Marketplace” – The Anyseller platform (website, app, and related services).
- “Seller” – Any business or individual who lists products or services on the Marketplace.
- “Consumer/Buyer” – Any individual who purchases products or services through the Marketplace.
- “Courier Partners” – Third-party logistics providers used for deliveries.
- “Payment Gateway” – Integrated payment providers enabling electronic transactions.
- “Wallet” – A digital wallet feature within the Marketplace that allows Consumers and Sellers to store, transfer, and withdraw funds in compliance with PASA rules.
- “We/Us/Our” – Anyseller (Pty) Ltd, the Marketplace operator.
- Marketplace Services
- We provide an online platform connecting Sellers, Promoters and Consumers.
- We do not manufacture, own, or control the products/services listed by Sellers. Sellers remain legally responsible for their products.
- We act as an intermediary, we facilitate order processing, payment collection, wallet management, and courier integration.
- All sales are direct contracts between the Seller and the Consumer.
- Seller Obligations
- Provide accurate product descriptions, pricing, and availability.
- Ensure compliance with consumer protection laws, health and safety standards, and all applicable regulations.
- Comply with the CPA (quality standards, return rights, warranties).
- Ensure all goods/services are lawful, non-counterfeit, and compliant with SA legislation.
- Honour all accepted orders unless out of stock (must notify the Consumer immediately).
- Accept returns/refunds in line with CPA requirements.
- Fulfil orders within the agreed delivery time.
- Maintain valid banking details for payouts.
- Pay applicable commissions, listing fees, and/or subscription charges.
- Authorise Anyseller (Pty) Ltd to deduct commissions, courier fees, or other applicable charges before payouts.
- Consumer Obligations
- Provide accurate delivery addresses and contact information.
- Ensure payment is completed via supported payment methods.
- Inspect goods upon delivery and report defects within 48 hours.
- Use the platform for lawful purposes only.
- Consumers have the right to clear information under CPA and ECTA.
- Right to cancel an order within 7 business days (“cooling-off period”), unless goods are exempt (e.g., perishables, digital downloads, hygiene products).
- Must provide accurate delivery and payment details.
- Must inspect goods upon delivery and notify the Marketplace/Seller of defects within 7 days.
- Payments and Fees
- Payments are processed securely via integrated gateways.
- The Wallet operates under PASA rules and may be used for:
- Storing funds for purchases
- Receiving refunds or Seller payouts
- Cash-out to linked bank accounts
- Anyseller deducts applicable commissions and/or service fees before transferring Seller payouts.
- Payment settlement timelines may vary depending on the payment gateway or bank processing times.
- In COD transactions, the delivery agent collects cash, which is then settled with the Seller (after fees/commissions).
- The Wallet operates under PASA rules and may be used for:
- Storing funds for purchases
- Receiving refunds or Seller payouts
- Cash-out to linked bank accounts
- Deliveries
- Deliveries are fulfilled via third-party Courier Partners.
- Delivery times are estimates and may vary due to traffic, availability, or unforeseen delays.
- Risk of loss passes to the Consumer once the product is delivered to the address provided.
- Courier fees are payable by the Consumer (unless otherwise stated).
- Anyseller is not liable for delays, damages, or losses caused by courier providers. Loss during delivery must first be raised with the courier provider; the Marketplace will assist in dispute resolution where possible.
- Returns, Refunds, and Cancellations
- Consumers have the right to return products within 7 days (Cooling-Off Period, per South Africa’s Consumer Protection Act), provided items are unused and in original packaging.
- Certain goods are non-returnable (e.g., perishables, digital downloads, hygiene products).
- Refunds will be processed via the original payment method within a reasonable period or wallet.
- Sellers are responsible for defective or misrepresented products.
- Courier fees for returns may be borne by the Consumer unless the Seller is at fault.
- Dispute Resolution
- Disputes between Sellers and Consumers should first be resolved amicably via the platform’s support system.
- If unresolved, Anyseller may mediate but is not obligated to resolve disputes.
- Consumers may escalate unresolved disputes under the Consumer Protection Act or other applicable laws.
- Prohibited Activities
- Listing counterfeit, illegal, or restricted goods.
- Using the platform for fraudulent transactions.
- Circumventing Marketplace fees by transacting outside the platform.
- Abusing courier services or refusing legitimate deliveries.
- Abusing Wallet services in breach of PASA regulations.
- Data Privacy
- Anyseller complies with POPIA (Protection of Personal Information Act, South Africa).
- Personal data is collected, processed, and shared only as necessary for transactions, deliveries, and payments.
- By using the Marketplace, you consent to sharing your data with Sellers, Couriers, and Payment Providers where required.
- Users may request access, correction, or deletion of their data as provided under POPIA.
- Data is used only for transaction processing, delivery, fraud prevention, and legal compliance.
- Liability
- Anyseller is not responsible for:
- Product quality, safety, or legality of products/services provided by Sellers.
- Delays, losses, or damages during courier delivery.
- Payment gateway errors or downtime.
- Our liability is limited to the value of the transaction in question.
- Termination
- We may suspend or terminate accounts for breaches of these Terms.
- Sellers remain liable for outstanding fees or unresolved transactions at the time of termination.
- Governing Law
- These Terms are governed by the laws of South Africa.
- Any disputes shall be subject to the jurisdiction of South African courts.
- Amendments
- Anyseller reserves the right to amend these Terms at any time.
- Continued use of the Marketplace after changes constitutes acceptance of the updated Terms.
- Dispute Resolution
- Disputes must first be reported to Customer Support.
- If unresolved, Consumers may escalate complaints under the Consumer Protection Act (CPA).
Disputes may also be referred to PASA (for payment issues) or the National Consumer Commission.
